Republic Act No. 9257 (2003) - The First Amendment

Republic Act No. 9994 (2010) - The Expanded Senior Citizens Act

Known as the “Expanded Senior Citizens Act of 2010,” this law significantly broadened the scope of benefits and privileges available to senior citizens.

Republic Act No. 11916 (2022) - The Most Recent Amendment

This latest amendment increased the social pension for indigent senior citizens and introduced additional provisions for their welfare.

Comprehensive List of Senior Citizen Benefits and Privileges

1. Shopping and Service Discounts

20% Discount and VAT Exemption on the following:

  • Medicines and Medical Supplies: Including influenza and pneumococcal vaccines, and other essential medical supplies, accessories, and equipment
  • Professional Fees: For attending physicians in all private hospitals, medical facilities, outpatient clinics, and home health care services
  • Medical and Dental Services: Diagnostic and laboratory fees in all private hospitals, medical facilities, outpatient clinics, and home health care services
  • Transportation: Actual fare for land transportation (public utility buses, jeepneys, taxis, Asian utility vehicles, shuttle services) and public railways (LRT, MRT, PNR)
  • Domestic Travel: Transportation fare for domestic air transport services and sea shipping vessels based on actual fare and advanced booking
  • Hospitality Services: Hotels, similar lodging establishments, restaurants, and recreation centers
  • Entertainment: Admission fees for theaters, cinema houses, concert halls, circuses, leisure and amusement facilities
  • Funeral Services: Funeral and burial services for deceased senior citizens

Important Note: In the purchase of goods and services which are on promotional discount, the senior citizen can avail of the promotional discount or the discount provided herein, whichever is higher.

2. Special 5% Discount on Basic Necessities

Related to Section 4 (j) of Republic Act No. 9994, please be guided on the existence of Joint DTI-DA Administrative Order No. 10-02, Series of 2010 and the amendment thereto under Joint DTI-DA Administrative Order No. 17-02, Series of 2017 providing a 5% discount to senior citizens for their purchase of prime commodities and basic necessities as these are identified or defined therein although there is a weekly limitation of PhP1,300.00 per senior citizen.

3. Utility Discounts

Senior citizens are entitled to a 5% discount on monthly utility bills for:

  • Water
  • Electricity
  • Telecommunications
  • Cable services

4. Tax Benefits

Income Tax Exemption: Exemption from the payment of individual income taxes of senior citizens who are considered to be minimum wage earners in accordance with applicable laws.

5. Financial Assistance Programs

Monthly Social Pension for Indigent Senior Citizens

Indigent senior citizens shall be entitled to a monthly stipend amounting to not less than One thousand pesos (P1,000.00) to augment the daily subsistence and other medical needs of senior citizens. (As recently amended by RA 11916)

Key Details:

  • Increased from ₱500 to ₱1,000 monthly under RA 11916 (2022)
  • The DSWD shall, subject to the approval of the Department of Budget and Management (DBM), in consultation with other stakeholders, review and, when necessary, adjust the amount of the social pension every two (2) years after the effectivity of this Act

Death Benefit Assistance of P2,000 to be given to the nearest surviving relative who cared for the deceased senior citizen until his/her death

6. Healthcare Benefits

Free Medical Services: Indigent senior citizens are entitled to free medical and dental services in government facilities, including:

  • Diagnostic and laboratory tests
  • Vaccination programs
  • Annual physical examinations

PhilHealth Coverage: All indigent senior citizens shall be covered by the national health insurance program of PhilHealth. The LGUs where the indigent senior citizens resides shall allocate the necessary funds to ensure the enrollment of their indigent senior citizens

7. Educational Benefits

Educational assistance to senior citizens to pursue post secondary, tertiary, post tertiary, vocational and technical education, as well as short-term courses for retooling in both public and private schools through provision of scholarships, grants, financial aids, subsidies and other incentives to qualified senior citizens, including support for books, learning materials, and uniform allowances

8. Employment Incentives

For Senior Citizens: Priority in employment opportunities and skills development programs

For Employers: Private entities that will employ senior citizens as employees, upon the effectivity of this Act, shall be entitled to an additional deduction from their gross income, equivalent to fifteen percent (15%) of the total amount paid as salaries and wages to senior citizens, subject to the provision of Section 34 of the NIRC, as amended: Provided, however, That such employment shall continue for a period of at least six (6) months: Provided, further, That the annual income of the senior citizen does not exceed the latest poverty threshold as published by the Philippine Statistics Authority (PSA) for that year.

9. Social Safety Assistance

Social safety assistance intended to cushion the effects of economic shocks, disasters and calamities shall be available for senior citizens. The social safety assistance which shall include food, medicines, and financial assistance for domicile repair, shall be sourced from the disaster/calamity funds of LGUs where the senior citizens reside

How to Avail of Senior Citizen Benefits

Required Documentation

To avail of these benefits, senior citizens must present any of the following:

  1. Senior Citizen ID: An identification card issued by the Office of the Senior Citizen Affairs (OSCA) of the place where the senior citizen resides: Provided, That the identification card issued by the particular OSCA shall be honored nationwide
  2. Philippine Passport: Valid passport showing the senior citizen’s age
  3. Other Valid Documents: As specified in the implementing rules and regulations

Where to Apply

  • Senior Citizen ID: Office of Senior Citizen Affairs (OSCA) in your city or municipality
  • Social Pension: Department of Social Welfare and Development (DSWD) offices
  • Healthcare Services: Local health centers and hospitals

Tax Deduction for Establishments

The establishment may claim the discounts granted under subsections (a) and (c) of this section as tax deduction based on the cost of the goods sold or services rendered: Provided, That the cost of the discount shall be allowed as deduction from gross income for the same taxable year that the discount is granted

This provision ensures that businesses providing discounts to senior citizens can recover some costs through tax deductions, encouraging compliance with the law.

Penalties for Non-Compliance

Any person who refuses to honor the senior citizen card or violates any provision of the Act and its Rules shall suffer the following penalties: 1. Not less than 50,000 but not exceeding 100,000 and imprisonment of not less than 2 years but not more than 6 years 2. Subsequent violation, a fine of not less than 100,000 but not exceeding 200,000 and imprisonment of not less than 2 years but not more than 6 years

Recent Updates and Future Outlook

The most significant recent update came with Republic Act No. 11916 in 2022, which doubled the monthly social pension from ₱500 to ₱1,000. The Social Pension for Indigent Seniors Act (RA 11916), which lapsed into law on 30 July 2022, has officially doubled the monthly pension from the current P500 to P1,000 per validated senior indigent.

The law also mandates regular reviews: The DSWD and NCSC will review and adjust the pension amount every two years based on economic indicators and the consumer price index.

Tips for Senior Citizens

  2. Know your rights - establishments are legally required to provide these discounts
